By creating an account or using Fluently (“the Service”), you agree to these Terms. If you do not agree, please do not use the Service. Fluently is operated by an independent developer (“we”, “us”).
You must be at least 18 years old to use Fluently. By using the Service you confirm that you are 18 or older and legally able to enter into these Terms.
Fluently is a conversational English-practice tool. You add vocabulary you want to master, and AI-driven companion characters (“personas”) converse with you by text or voice, weaving those words into conversation and scoring your usage.
Personas are software, not people. Every persona is an AI character generated by a large language model. It is not a human being, not a real relationship, and not a licensed professional of any kind — even when it refers to itself in the first person, remembers details about you, or expresses warmth, affection, or opinions. Any sense of friendship or intimacy is a simulated experience produced by software.
Fluently is for language practice and entertainment only. It does not provide medical, psychological, therapeutic, legal, financial, or other professional advice, and must not be relied on as a substitute for a qualified professional. It is not a counselling service, not a mental-health treatment, and not a crisis or emergency service.
If you are in distress or considering harming yourself, please contact your local emergency number or a crisis helpline immediately. Do not rely on Fluently for help in an emergency.
You are solely responsible for any decision you make or action you take based on anything a persona says.
Persona replies, word meanings, examples, topic suggestions, and proficiency scores are all generated by AI. AI output can be inaccurate, outdated, biased, inappropriate, or simply wrong, including in its language teaching and its scoring. We do not review or verify it before you see it, and we make no promise that it is correct, suitable, or fit for any purpose. Please use your own judgement, especially for anything that matters.

We may suspend or terminate any account that violates these Terms, at our discretion and without notice.
You keep ownership of the content you create (vocabulary, notes, messages, personas). You grant us a limited licence to store and process it solely to operate the Service for you, as described in our Privacy Policy. We do not use your conversations to train our own models.
Fluently is provided on a best-effort basis by a single independent developer. We may change, suspend, limit, or discontinue any part of the Service — or the whole Service — at any time, with or without notice. Features may break, and the Service may be unavailable.
We do not guarantee that your data will never be lost. Please do not use Fluently as the sole store of anything you cannot afford to lose.
The Service is currently free to use (aside from your own AI provider costs). We may introduce paid plans in future. If we do, pricing, billing, and refund terms will be presented to you before you are charged, and any purchase made through the Google Play Store will additionally be governed by Google’s terms.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ITS OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY AI-GENERATED CONTENT, ANY RELIANCE ON A PERSONA, ANY API PROVIDER CHARGES, OR ANY UNAUTHORISED ACCESS TO YOUR DATA.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) INR 1,000.
Some jurisdictions do not allow certain exclusions or limitations of liability; in those places, the above applies to the fullest extent permitted, and nothing in these Terms limits liability that cannot lawfully be limited.
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or your violation of any law or third-party right.
You may stop using the Service and delete your data at any time (Settings → Data management, or by emailing us). We may terminate or suspend your access at any time for breach of these Terms or to comply with the law. Sections 4, 5, 7, and 10–12 survive termination.
These Terms are governed by the laws of India, and the courts of India shall have exclusive jurisdiction, except where mandatory local consumer-protection law in your country of residence grants you different rights.
We may update these Terms as the Service evolves. The “last updated” date will change, and material changes will be communicated in the app or by email. Continuing to use Fluently after an update means you accept the revised Terms.
